A Grenadian native who has been living in the BVI for the past 24 years is being accused of severely beating his girlfriend over another man at his Purcell Estate apartment on Sunday evening.

Ted Rogers, a captain with Caribbean Transport Limited who was charged with assault occasioning actual bodily harm, was granted $30,000 signed with surety and $5,000 to be paid in cash when he appeared in court on Tuesday before Senior Magistrate Valerie Stephens.

Rogers who was represented by Lawyer Cheryl Rosan, was also ordered to stay away from the complainant, Marrisia Duncan.

Crown Counsel Leslie Ann Faulkner told the court that Rogers and Duncan are involved in a relationship and share an apartment. On July 25 around 8:15 pm, Duncan returned home only to realize that she left her keys inside the apartment. The woman then called Rogers and asked him to return home with his keys so she can gain entry.

The complainant told Police that while she was there waiting on Rogers, a male friend came and kept her company. However, when Rogers reached home and saw the friend, it did not sit well with him.

Faulkner told the court that the friend then left and both Duncan and Rogers went inside the house where Rogers began to quarrel. He then hit the complainant in her head, but according to the Crown Counsel, the woman ignored him. She then went into the bedroom and then to the bathroom, where he followed her and grabbed her neck and started to choke and punch the woman in her head, back and shoulders using his other hand.

After being able to push him off, the complainant ran into the bedroom with Rogers in hot pursuit of her and he continued to deal her blows. Duncan said that at one point she was unable to breathe and then at one time she was able to bite him.

When he was done with the beating, Rogers left the bedroom and Duncan told Police that she called the same male friend who was with her outside to call the Police.

The Police officer stated that while on the scene, he noticed that the complainant was bleeding from her left ear. She was taken to the hospital.

The court was told that the medical report from the hospital is still outstanding.

Woman Trying to Provoke Defendant

Meanwhile, his lawyer before going into her bail application told the court that Rogers and the complainant are no strangers to the court. She said following the previous issue, the complainant had moved in with her sister, but that did not work out so she asked Rogers to move in with him.

However, Stephens told the lawyer not to go into the previous case since it has been appealed and is still before the court.

Rosan said that as part of her client´s remuneration package, he is allowed to stay at the apartment which is owned by his employers. She said that when he is not on island, he stays on the vessel.

The lawyer said that when Duncan moved in at Rogers' apartment, they rekindled.

Speaking on the night in question, Rosan said Rogers was in Cane Garden Bay with a friend who just got married. At the time, the complainant called and asked him to return home to open the door.

Rosan further told the court that Rogers then met Duncan and another male on the stairs of the apartment and according to Rosan, this was just one of many acts of provocation by her to aggravate the defendant.

She said that Duncan continues to engage in intimate relationships with other men and throws it in the defendant´s face by bringing the men to the apartment.

According to the lawyer, during the argument, her client was merely pushing the complainant from out of his way at the bathroom area. She said in the bedroom, he was about to have play intercourse with the woman who started to scream, "and the next thing he know, it was the Police by his apartment."

Rosan asked the court to order Duncan to move from her client´s premises; however the Prosecutor informed the court that she has since moved out.

Rogers will have to return to court on October 28, 2010 when the Preliminary Inquiry is expected to commence.
