Delta Moves to Court Over BVIEC Fuel Tender

Following an application filed by Delta Petroleum (Caribbean) Limited, High Court Judge, Justice Rita Olivetti has granted leave for Delta to make a claim for a judicial review into the tenders for the supply of fuel to the BVI Electricity Corporation (BVIEC).

The order was granted based on an affidavit submitted by Delta´s Regional General Manager, Bevis Sylvester.

Delta Petroleum was one of two companies that submitted bids to the BVIEC to supply diesel fuel and lubricating oil for a period of two years, commencing September 2010. Without explanation, the bids were thrown out and a new tender process started.

Delta is seeking to have the court quash the decision to throw out the bids on the grounds that the decision was not made in accordance with the BVIEC Act Revised Laws of the Virgin Islands.

Delta wants the court to grant a restraining order against Mr. Allan Parker, the Chairman of the BVIEC Board, from taking any further part in the present tender process on the grounds of conflict of interest and/or bias and acting in bad faith in the performance of his duties as Chairman of the BVIEC.

Delta also wants a restraining order against Mr. Julian Willock, the Permanent Secretary in the Ministry of Communications and Works and an ex-officio member of the Board of Directors of the Corporation, from taking any further part in the present tender process on the grounds of bias and acting in bad faith in the performance of his duties as a member of the Board of the Corporation.

Additionally, Delta also wants the BVIEC to reconsider the company´s tender for the present fuel contract in accordance with the Act, and as far as possible, to provide reasons for its decision in the matter.

Further, Delta is also seeking an injunction restraining the BVIEC, its servants, agents or whosoever, from commencing or continuing with the award of tenders for the fuel contract pending the determination of the claim made by Delta Petroleum.

SOL BVI Limited had submitted a bid of $64,101,303.44, while Delta Petroleum´s bid was $63,328,813.71.

Following the restart of the bid process, the new closing date is now August 6.

Both bids are over 60 million, so i suggest that since we are in a recession and everyone needs to eat, that they should split the contract. Arbitration is one route but that has been nullified since Delta has opted for the judicial process! This chap Willock suddenly spring into the news on the dark side of things. This is very strange. I want to believe he has more sense than to do these things on his own authority.

So it looks to me like the buck is stopping somewhere else (higher).

ask urself why parker asked back for the money ...obviously he and the rest of the board are not 'yes men' for the minister. i am sure the minister if left to his own devices would not have asked back for the money. he must be pissed with the board of BVIEC now

Please understand what is really going on before putting down silly comments. I am not a fan of mr.Bevis, but if a tender was put out and the law states that the contract should go to one that applied for the contract, and this is not followed through he has every right to take this to court.... more

It isnt anything about Delta losing to Shell, its basically that two of them BID and the whole Tendering was thrown out. They keep doing this nonsense, next thing you know u read a statement on BVIPLATINUM that some outsider who have no affiliations to the BVI have the job.

I think he is complaining for the process the bidding of contracts were done. The bidding was not done in a fair, lawful and legal manner.

That is all the man is complaining about. Nothing to do with BVIslander etc.

This is stupidness!! I hope Delta loose and they pay the Government with interest. They want everything! What does Alan Parker and Willock have to do with Sol? As far I am concerned they have to interest in any of these two companies. I stop buying any gas from Delta thats pure greediness.
