Following an application filed by Delta Petroleum (Caribbean) Limited, High Court Judge, Justice Rita Olivetti has granted leave for Delta to make a claim for a judicial review into the tenders for the supply of fuel to the BVI Electricity Corporation (BVIEC).
The order was granted based on an affidavit submitted by Delta´s Regional General Manager, Bevis Sylvester.
Delta Petroleum was one of two companies that submitted bids to the BVIEC to supply diesel fuel and lubricating oil for a period of two years, commencing September 2010. Without explanation, the bids were thrown out and a new tender process started.
Delta is seeking to have the court quash the decision to throw out the bids on the grounds that the decision was not made in accordance with the BVIEC Act Revised Laws of the Virgin Islands.
Delta wants the court to grant a restraining order against Mr. Allan Parker, the Chairman of the BVIEC Board, from taking any further part in the present tender process on the grounds of conflict of interest and/or bias and acting in bad faith in the performance of his duties as Chairman of the BVIEC.
Delta also wants a restraining order against Mr. Julian Willock, the Permanent Secretary in the Ministry of Communications and Works and an ex-officio member of the Board of Directors of the Corporation, from taking any further part in the present tender process on the grounds of bias and acting in bad faith in the performance of his duties as a member of the Board of the Corporation.

Additionally, Delta also wants the BVIEC to reconsider the company´s tender for the present fuel contract in accordance with the Act, and as far as possible, to provide reasons for its decision in the matter.
Further, Delta is also seeking an injunction restraining the BVIEC, its servants, agents or whosoever, from commencing or continuing with the award of tenders for the fuel contract pending the determination of the claim made by Delta Petroleum.
SOL BVI Limited had submitted a bid of $64,101,303.44, while Delta Petroleum´s bid was $63,328,813.71.
Following the restart of the bid process, the new closing date is now August 6.
